These terms are an agreement between you and us about using the Audio Flashcards apps for iPhone, iPad, Mac and Android (the "Application"), the websites at audio-flashcards.com and docs.audio-flashcards.com (the "Website"), and Shared Cards (together, the "Services"). By using the Services, you agree to these terms. Our Privacy Policy explains how we handle your information.

Who we are

The Services are provided by Audio Flashcards ("we", "us"), based in Australia. You can contact us at [email protected].

Who can use the Services

You can use the Application without an account. You must be at least 13 years old, or the minimum age to consent to data processing in your country if that is higher, to create a Shared Cards account. If you are under 18, you need a parent or guardian's permission to make purchases.

Using the Services

You may use the Services for your own study and for teaching, but not to run a business built on them, such as reselling access to the Services or to other people's collections, without our written permission.

You must not:

  • use the Services unlawfully, fraudulently, or in a way that harms other people or us;
  • interfere with or disrupt the Services, try to get around their security or limits, or try to access accounts or data that are not yours;
  • use automated tools such as bots or scrapers to access or copy the Services, except the ordinary use of the Application and the Website;
  • copy, modify or reverse engineer the Application, except where the law allows you to; or
  • pretend to be someone else.

Your library

The cards, recordings and other content you make are yours. They are stored on your device and, if you use iCloud, in your iCloud Drive. We do not receive them unless you publish them to Shared Cards. You are responsible for keeping your own backups: the Application can make backup files for you.

If you send us ideas or feedback, we may use them to improve the Services without owing you anything.

Accounts

A Shared Cards account lets you publish collections, open invitation links, and report collections. You can sign in with Apple, Google, or a one-time code sent to your email address. Keep your sign-in methods secure. You are responsible for activity on your account, and you must not use another person's account or let someone else use yours. Tell us straight away if you think someone else is using your account.

You can delete your account at any time from your Shared Cards profile in the Application.

Shared Cards

Shared Cards lets you publish collections of flashcards from the Application and download collections other people have published. This section applies to everything you publish or download through Shared Cards.

Public and private collections

A public collection is listed in the Application and on the Website, where anyone can see its details, preview its cards, and download it without an account. A private collection can only be opened through an invitation link you share. Anyone who has one of your links and an account can open the collection and download a copy, so only share links with people you are happy to give a copy to.

Public collections are credited to the display name and photo on your Shared Cards profile. We never show the name, picture, or email address from the account you sign in with.

What you publish

You keep ownership of the collections you publish. By publishing a collection, you confirm that:

  • you own it, or have permission to share all of it, including its text, recordings, images, and any audio made with a text-to-speech voice or service (some voices and services have their own rules about sharing what they produce);
  • anyone whose voice can be heard in your recordings has agreed to it being shared; and
  • it does not break the law or anyone else's rights.

You give us a worldwide, non-exclusive, royalty-free licence to store, copy, convert, display, and distribute each collection you publish to the people it is shared with (everyone, for a public collection, or people who open your links, for a private one), and to show previews of public collections on the Website. This licence lasts until the collection is removed, except for copies people have already downloaded.

You also give everyone who downloads one of your collections permission to keep it, study with it, and adapt it for their own study. They may share collections built from your public collections through Shared Cards, where the Application credits your collection as the source.

Publishing never includes your review history, grades, flags, or other study progress.

Content that is not allowed

Do not publish collections, profiles, or link names that:

  • are unlawful, or that infringe copyright, trademarks, or other rights;
  • share someone's personal information, or recordings of them, without their permission;
  • harass, threaten, defame or demean people, or promote hatred or violence;
  • are sexually explicit, or sexualise minors in any way;
  • contain malicious files, or are built to break or misuse the Application or the Website;
  • are spam, advertising, or deliberately misleading; or
  • impersonate another person or organisation.

Automatic checks

Collections are not reviewed by a person before they are listed. Two automatic checks help keep Shared Cards fair and safe:

  • Copied recordings. We compare a fingerprint of the audio in each collection with collections already published. A collection made mostly of another account's recordings can be shared privately but cannot be listed publicly, and recordings copied from a private collection cannot be published.
  • Reported collections. When enough people report a collection, it is hidden from everyone except its owner until a moderator has reviewed the reports.

Reporting content

Anyone who is signed in can report a collection with Report Collection in the Application. Anyone, with or without an account, can tell us about content they believe is illegal by emailing [email protected]. Please include:

  • a link to the collection or profile;
  • what you believe is illegal, and why;
  • your name and email address, unless the report is about child sexual abuse material; and
  • a statement that you believe your report is accurate and complete.

We review reports promptly and fairly, and tell you what we decided. If we use automated means to process your report, we will tell you.

Our decisions

We may unlist, hide, or remove collections, profiles, or links, and suspend or close accounts, that break these terms or the law. When we do, we will tell you what we did, which content it affects, why, whether automated means were involved, and how to ask us to reconsider, unless the law prevents it or the content is misleading spam.

If you disagree with a decision, by us or about a report you made, email [email protected] within six months. A person will review it, and we will tell you the outcome. If you are in the European Union, you may also be able to use a certified out-of-court dispute settlement body, and you can always go to court.

We may suspend accounts that repeatedly publish clearly illegal content, or that repeatedly send reports that are clearly unfounded, after warning them first.

Updates and removing collections

You can publish new revisions of a collection. People who downloaded it choose when to update, and updating never resets their study progress.

You can unpublish a collection, which stops new downloads and updates, or remove it, which takes it down permanently. We delete the copy on our servers about 30 days after you remove a collection. Deleting your account permanently deletes your account, your profile, and every collection you have published.

People who have already downloaded a collection keep their copy on their own devices after it is unpublished, removed, or deleted, or after their access is revoked. We cannot remove those copies.

Availability

Shared Cards is provided free of charge. We may change, limit, or end it, and will give you reasonable notice where we can. Keep your original cards in your own library: publishing a collection does not back it up.

Marketplace

Marketplace has been replaced by Shared Cards. Collections from Marketplace have moved to Shared Cards and are covered by these terms. Shared Cards is free: collections cannot be sold, and we do not pay publishers.

Purchases and subscriptions

The Application is free to use with ads. You can remove the ads with a subscription or a one-time lifetime purchase. Watching an optional rewarded ad unlocks a period without interruptions.

  • Where you buy. All purchases are made through the App Store or Google Play, which take your payment under their own terms.
  • Renewal. Subscriptions renew automatically at the end of each period, at the price shown when you subscribed, unless you cancel at least 24 hours before the period ends.
  • Cancelling. You can cancel or manage a subscription in your App Store or Google Play account settings. Deleting the Application does not cancel a subscription. When you cancel, ad-free access continues until the end of the period you paid for.
  • Price changes. If a subscription price changes, the App Store or Google Play will tell you beforehand, and you can cancel before the new price applies.
  • Lifetime purchase. A lifetime purchase gives you ad-free access for as long as we offer the Application on that store, on the devices signed in to the same App Store or Google Play account.
  • Restoring purchases. If ad-free access does not appear on a new device, use Restore Purchases in Settings > Manage Purchases.
  • Refunds. Refunds are handled by Apple or Google under their policies. This does not limit your rights under consumer law, described below.

Advertising

The free version of the Application shows ads provided by Google. Advertisers are responsible for their ads. Our Privacy Policy explains how ads use your information and how to limit personalised ads.

Other services

Some features rely on other companies' services, such as iCloud, Sign in with Apple, Sign in with Google, and Amazon Polly or OpenAI voices you choose to add. Their terms apply to your use of them, and we are not responsible for them.

If you downloaded the Application from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple is not responsible for the Application or its support, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Our content

The Application, the Website, and their design, text, graphics, software, and the Audio Flashcards name and logo belong to us or our licensors. We give you a personal, non-transferable licence to use them as these terms allow. Content other people publish in Shared Cards belongs to them.

We respect copyright and expect you to. If you believe content in the Services infringes your copyright, email [email protected] with:

  • the work you believe is infringed;
  • a link to where the infringing content appears;
  • your contact details;
  • a statement that you believe in good faith the use is not authorised by you, your agent, or the law; and
  • a statement that the information in your notice is accurate and that you own the copyright or are authorised to act for the owner, with your physical or electronic signature.

We remove infringing content when we are notified of it. We close the accounts of people who repeatedly infringe.

Changes to the Services and these terms

We keep improving the Services, so features may change, and we may stop offering some of them. If we stop offering a paid feature you have paid for, we will tell you and, where it is fair, offer a refund for the part you have not used.

We may update these terms. If a change is significant, we will tell you in the Application or by email at least 30 days before it takes effect, unless the change is needed sooner for legal or security reasons. If you do not agree to the change, you can stop using the Services and delete your account. Continuing to use the Services after a change takes effect means you accept it.

Suspending or ending your access

You can stop using the Services at any time. We may suspend or end your access to Shared Cards, or to the Services, if you seriously or repeatedly break these terms, if the law requires it, or to protect other people or the Services. We will tell you why and how to ask us to reconsider, as described under Our decisions, unless the law prevents it. Ending your access does not affect your library on your device, or any paid subscription period you are entitled to under the store's terms.

Consumer law

Nothing in these terms limits rights you have under consumer law that cannot be excluded.

Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

European Union and United Kingdom. If you are a consumer, you have legal rights in relation to digital content and services that are not as described or not working properly. These terms do not affect those rights.

Disclaimers and liability

Except for the guarantees and rights described under Consumer law, the Services are provided as they are and as available. We work to keep them running and accurate, but we do not promise that they will always be available, error-free, or suit your particular purpose, or that content other people publish is accurate. Audio Flashcards is a study tool and does not guarantee any particular learning result.

To the extent the law allows:

  • we are not liable for losses that were not reasonably foreseeable, or for loss of profits, business, or opportunity;
  • we are not liable for losses caused by content other people publish, by other companies' services, or by events outside our reasonable control; and
  • our total liability to you for all claims about the Services is limited to the amount you paid us in the 12 months before the claim, or AUD 100 if that is more.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Where the Australian Consumer Law allows our liability for a failure to comply with a guarantee to be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

Governing law

These terms are governed by the laws in force in Australia, and disputes are to be resolved in Australian courts. If you are a consumer living in another country, you also keep the protection of the mandatory laws of your country, and you can bring a claim in your local courts.

General

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce part of these terms straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours to a business that takes over the Services, provided your rights are not reduced. These terms, together with the Privacy Policy, are the whole agreement between you and us about the Services.
